DARKESTYET 07-01-2004, 06:27 PM I GOT SOME DEVASTATING NEWS TODAY...AFTER 3 1/2 YEARS AND 5 VISITS TO THE US..MY HUSBAND (NOT WITH PAPER) WAS DENIED HIS B2 VISA...HES BEEN HERE 5 TIMES AND NEVER HAD A PROBLEM GETTING HIS B2 BEFORE...BUT NOW THIS!!
THAT WAS PRETTY HARD TO TAKE BECAUSE WE WERE PLANNING ON HIS BEING HERE NEXT WEEK..
OK ON TO PLAN B EH?
TALKED TO A LAWYER THIS MORNING WHO VOLUNTEERS TO HELP WITH IMMIGRATION MATTERS...SHE ADVISED I GO THERE AND MARRY HIM...COOL!
THEN I SAW A SITE THAT SAYS 100% SUCESS WITH K1 K3 VISAS
AND FREE CONSULT WITH A REAL LAWYER..
HE SAID NO WAY IN HELL HE WILL EVER GET A K1 OR K3 VISA BECAUSE OF OUR AGE DIFFERENCE..
IT IS SUBSTANTIAL BUT YOU GUYS CAN RELATE EH?
32 YEARS.OK?
THIS SECOND LAWYER ALSO SAID WE HAVE NO RIGHTS AT FOREIGN CONSULATES..AND THAT IF HE COULD GET HERE FOR US TO MARRY WE MIGHT HAVE A CHANCE CUZ WE WOULD HAVE PROTECTION OF THE LAW AGAINST DISCRIMINATION...
DOES ANYBODY OUT THERE HAVE ANY IDEAS WHAT WE CAN DO??

I don't have much to say to you, because I don't live in the US and have just a touristic visa to see my boyfriend, but there are people here going through the other immigration procedures.

marcy 07-02-2004, 08:01 AM It is completely UNTRUE that you will never get a k1/k3 visa due to agegap. In fact, a k1/k3 visa, if all paperwork is followed appropriately AND your partner has no medical or criminal problems they are almost UNIFORMLY approved!!! It is a VERY VERY VERY rare k1/k3 visa that is denied. I am a member of a k1/k3 forum and know many, many, many (did I mention many?) couples with large age gaps in both directions (om/yw and ow/ym) that have successfully completed the k1/k3 process all the way to citizenship. In fact when I joined that forum, I expressed my fears that we would never get one because we have an 18 year agegap and I was told that noone in the forum had EVER heard of someone being denied for that reason. The community is about 5,000 members ;). Relax and fill out the paperwork... it is FOR SURE the right thing to do!!!
Also... border denials will not create a difficulty for a k1/k3 applicant.

marcy 07-02-2004, 10:17 AM Don't panick... I would have recommended my forum to you, but its for Canadian-American immigration. Search the web, and look here too, to find forums that specialize in K1/K3 processes. The process is long and stressful... but almost always successful. There are even couples in this community with very large agegaps that have successfully immigrated. You do not need a lawyer to complete this process, but if you do decided to use one... screen carefully. There are a lot of people looking to make a buck on this process.

whiterose 07-02-2004, 11:10 AM Hi Darkestyet. I know that you PM'd me asking me to forward your info onto a friend of mine (not an ageless member) who married a man from Turkey. If you'll PM me your email address I'll ask her if she would be willing to contact you to discuss the situation. Their age gap is 17 yrs. Not as big as yours, but an age gap nonetheless. They married in Turkey just prior to 9/11. They did the Direct Consulate Filing (DCF) route. She told me that they experienced a delay mostly because of the fact that she was not knowledgeable enough about all the documentation she needed to take with her to Turkey when she went there to marry him.
So, do educate yourself on all the documents that you'd need to have available if you do decide to marry him there. The DCF route, if in fact you are eligible for, is the fastest route. But, you need to understand his country's eligibility requirements.
There's alot of good information on visajourney.com. You can reach out to other members there. They even have a chatroom. I haven't yet talked to many other members, but you may have luck finding someone who is trying to move their fiance from Turkey to the U.S.
Also, Marcy is right. You don't need an attorney to go through this. I consulted with one initially, but immediately decided to do this on my own when he wanted to charge me $2000 just for PART of the whole process. :eek: It's really easier than doing your income taxes. You just have to understand all the documentation necessary. You can get that info on visajourney.com.
Btw, I did ask the attorney I consulted if he ever heard of a K1 visa being turned down. He said he had not. I did not ask about the K3, though. But, he told me that despite the age difference, he did not feel there would be any problem as long as the documentation is all in order.

Hi Darkest! Guess what--my boyfriend is Turkish, too! That makes three of us Ageless women (including Guinavere) with younger Turkish boyfriends/husbands. Our age gap is 23 years--he is 35 and I am 58--until August when it will be 24! I am sorry that you are having trouble with the INS. My boyfriend just got his permanent residency renewed after several years of struggle. You can read a brief version of his story in the post below:

So, you need to be strong and patient when dealing with INS. Educate yourself as much as possible and join some immigration forums where you will learn from others' experiences. Yahoo has a good one. Make sure your paperwork is meticulous. Most important of all, stay close to the Ageless members in the Immigration thread. You guys can all support and encourage each other.

My husband is Turkish, (I am 47 he is 25) but he was born and raised in Australia. I moved to Australia to be with him. So I am dealing with immigration there. Eventually we may move back to the USA and at that point I will most likely go the Direct Consulate way, because we are legally married. It it is usually quicker to do that that than apply for a K-3 visa.
I agree with everyone so far that has told you to become familiar with all the paperwork involved in getting your sweetheart into the US. It is rare that a fiance visa would be denied. YOu live in the midwest and most likely you will be dealing with the Nebraska center. I hate to be the bearer of frustrating news, but the Nebraska center has a reputation for being the slowest in processing visa applications. However, don't let that keep you from getting started on the application process. And just know that the sooner you get started, the sooner he gets here.

You may want to try to find out if you can do the direct consular filing route in Turkey. I'm not sure. I couldn't find a link to their embassy on visajourney.com.
About processing timelines... well, since I began this whole "journey" I have heard mixed things about which center has the slowest timelines. The attorney I consulted told me that Texas is the worst. At the time I talked to him in April, he indicated that Nebraskas was the best. But, if you look at the processing timelines here, you'll see that Nebraska and Texas are running a dead heat for last place. :mad:

I am starting to get very discouraged already. I had been delaying seeing Remi again until we had some idea about when the visa will be approved. But, I think I'm going to return to see him this fall now. Because I can't wait for 6-8 more months (or more) from now just to see him again. That's about how long I'm estimating it will take to approve his visa based on the fact that we haven't even officially begun as we're waiting for his papers to come back to me. :rolleyes:

The process is of course the same, however, it is a bit different in that Canadians do not need a visa to visit America and they can stay for up to 6 months a visit. I strongly encourage you to followup with visajourney.com. I have also found that site to be extremely helpful.
